Terms of Service & Customer Insurance Service Information
Brokers
By registering an account with BluNiche UK via the website, brokers will be deemed both to have read and accepted these Terms, and to have agreed to provide them to the Policyholders prior to the point of sale. These Terms should be read in conjunction with our Privacy Policy.
BluNiche UK Commercial Policyholder Terms of Service
Blu Niche UK is a trading style of Blu Niche Risk Services Ltd which is located at 1st Floor, 8 Lloyd’s Avenue, London, EC3N 3EL. Blu Niche Risk Services Ltd is an Appointed Representative of D A Strategy Ltd (D A Strategy) Company Registration number 09866002 located at 2 Minster Court, Mincing Lane London, EC3R 7BB. DA Strategy is authorised and regulated by the Financial Conduct Authority and listed on the Financial Register under number 927590. For the purposes of these Terms of Service (Terms) the word Policyholder refers to:
- a UK business or person acting within their business, trade or profession and their brokers, and;
- includes prospective as well as existing Policyholders.
These Terms come into force on the day a Policyholder applies for insurance and remains so until termination of this agreement by either party or the insurance expires and all claims under it are paid. It sets out the terms of our relationship with our Policyholders and their brokers for the provision of product recall insurance quotes and binding product recall insurance on the broker’s instructions. Policyholders should contact us immediately on receipt of these Terms if there is anything in them they do not understand or disagree with.
We update our Terms to comply with legal, regulatory and market practices. For that reason, upon your receipt of these Terms, they shall replace and take priority any previous Terms issued by us.
Our Insurance Services
BluNiche UK acts exclusively as agent to Chaucer Insurance Company DAC.
We will:
- Provide Policyholders’ brokers with insurance quotes;
- Bind insurance cover on brokers’ instructions; and
- Arrange for the administration of Policyholders’insurance policies, including policy documents and invoices.
We will not give any advice or personal recommendations as to the insurance’s suitability. Policyholders must devide for themselves whether the product meets their business needs.
In providing quotes and binding insurances, we work exclusively for Chaucer Insurance Company DAC (Chaucer) which insures all policies transacted by Blu Niche UK and which is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and Prudential Regulation Authority under Financial Register number 783383.
Blu Niche UK is not entitled to hold client monies. For your client’s protection, Blu Niche UK holds all monies passing to it in respect of insurances it transacts as Chaucer’s agent including:
- all premium and insurance premium taxes; and
- any return premium and insurance premium taxes.
Demands and Needs Statement
This insurance product that we distribute meets the demands and needs of a UK business or person acting within their business, trade or profession who wants product recall insurance.
Your Responsibilities
Policyholders must pay all premiums and other charges in the timeframe specified in writing. Failure to pay premium may lead to the cancellation and/or avoidance of the insurance.
When we bind insurance, we aim to send policy documentation Policyholder’s broker within 30 days. Policyholders must review carefully any documentation supplied by us and must contact their broker immediately on receipt if any such documentation does not appear to be in accordance with the Policyholder’s requirements or if there is doubt about any of the policy’s provisions. If not, we shall be entitled to assume that the documents we provided to you meet the Policyholder’s requirements.
Duty to Disclose Information
By statute, Policyholders are required to make a fair presentation of the risk that they seek to insure. To make a fair presentation of the risk they must either (1) disclose all Material Information that they know or ought to know or (2) provide Blu Niche UK as the insurer’s agent with sufficient information to put us on notice that we need to ask further questions to reveal all the Material Information.
Policyholders will be deemed to know all Material Information that is known to their senior management or those responsible for arranging their insurance, and which should reasonably have been revealed by a reasonable search.
Failure to disclose all Material Information or misrepresenting circumstances could result in: the terms of the insurance contract being rendered void (so that claims are not paid and there is no cover); terms being amended or Chaucer reducing any claim(s) paid in proportion in the increased premium that would have been charged had the true position being known. Chaucer may also have a right to recover all or part of any claim payments made.
“Material Information” means all information that would influence an insurer in determining whether to accept the risk and, if so, the premium, terms and conditions to be applied. Policyholders in doubt as to whether information might be relevant to an insurer’s determination should disclose it.
Our Remuneration
We are remunerated for sales of the insurance product by way of commission and a policy issuance fee of up to £500. We will provide further details to you upon request.
Use of material on the BluNiche UK website
We are the owner or the licensee of all intellectual property rights on the BluNiche Risk Services website(s), and in the material published on it and/or generated by it. These works are protected by copyright laws. All such rights are reserved.
Cancelling the Policy
To cancel any insurance policy please contact your broker.
Complaints
We are dedicated to providing a high-quality service and we want to ensure that we maintain this at all times. Policyholders with questions or concerns about the insurance product or the handling of a claim should contact their broker. A Policyholder in the UK who remain dissatisfied after we have considered their complaint, or who has not received a decision by the time we have taken eight (8) weeks overall to consider their complaint, may be eligible to refer their complaint to the Financial Ombudsman Service (FOS) at:

Alternatively, as Chaucer is based in Ireland, any Policyholder (in the UK or Ireland) who remains dissatisfied after we have considered their complaint, or who has not received a decision by the time we have taken forty 40) business days overall to consider their complaint, may be eligible to raise the matter with the Financial Services and Pensions Ombudsman (FSPO) an independent body that adjudicates on complaints, at:

Financial Services Compensation Scheme (FSCS)
Chaucer is covered by the FSCS. Policyholders may be entitled to compensation from the FSCS for up to 90% of the claim value with no upper limit if Chaucer cannot meet its obligations depending on the type of business and the circumstance of the claim. Data Protection
This section describes how Blu Niche UK collects and use the personal information of Policyholders, claimants, their agents and other parties (for the purposes of this notice, “You”) under this section of these Terms in accordance with the Data Protection Act 2018 and applicable data protection law. If You provide us with information about someone else, we will process their personal information according to this section. Please ensure you provide them with a copy of this notice.
The personal information provided to Blu Niche UK and other information obtained from or about You in connection with this policy, will be used by Blu Niche UK, D A Strategy, Chaucer, RQA Group and their group companies, RQA Group, agents and reinsurers for the purposes of insurance operations, which includes the process of underwriting, administration, claims management, insurance analytics, complaints and fraud prevention. Such parties may become data controllers in respect of Your personal information. Chaucer operates as part of a global business and may transfer Your personal information outside the European Economic Area for these purposes.
You have certain rights regarding your personal information including the rights to request access, rectification, erasure, restriction, objection and receipt of Your personal information in a usable electronic format and to transmit it to a third party (right to portability). Confidentiality
Each party to any insurance contract transacted by Blu Niche UK and their agents will treat information received from the other relating to these Terms as confidential and will not disclose it to any other person not entitled to receive such information except as may be necessary to fulfil their respective obligations in the conduct of the insurance business or as may be required by law or a regulatory authority.
Law & Jurisdiction
These Terms shall be governed by English law and subject to the exclusive jurisdiction of the Courts of England and Wales.
